Terms & Conditions

DEFINITIONS: 

“THE "BUSINESS” means Slumber Nights. ABN: 51302898204 

“THE RENTER“ means the person(s) hiring equipment and/or purchasing purchase items.

“EQUIPMENT” means goods hired as they appear on the Booking Agreement. “PURCHASE ITEMS” means goods purchased as they appear on the Booking Agreement, and not expected to be returned to the business.

"GOODS" means equipment and purchase items.

“THE AGREEMENT” means the Booking Agreement of goods ordered, including Terms and Conditions. 

"EVENT" means the event, gathering or occasion, for which the goods are being provided 


BOOKING AND DEPOSIT
A non-refundable deposit of $80 will be required at time of booking to secure your event date(s), the renter will have 48 hours of cooling off period, from payment of deposit to cancel and full refund will be executed. After the 48 hours of initial payment, the $80 deposit will not be refunded. Payment of deposit may be in the form of direct deposit with bank deposit details available on the business website.  The deposit must only be paid upon having read and acknowledgment of the terms and conditions of this agreement.  This $80 will contribute toward the overall cost of the invoiced amount.


FINAL PAYMENT
All unpaid payments are due 7 days prior to the date of the event.  Balances to be paid include the final total on the invoice, minus the deposit paid.  Final balances not received prior to this deadline will result in the cancellation of the event.  Equipment and services reserved by the renter for the cancelled event date(s) will then be made available to other renters. Slumber Nights will call and send emails about final payments as reminder.


CANCELLATION OR RESCHEDULE
The $80 deposit is non-refundable.  For complete cancellations for any reason more than 7 days prior to the event, this amount will be returned by the renter.  For outright cancellations within 7 days of the event, 50% of the invoiced/paid amount will be surrendered by the renter.  Any amount paid to the business by the renter may be used as credit towards a event at a rescheduled date, a gift voucher, or may be used to purchase other goods or services available from the business.


FORM OF PAYMENT
Payment of a deposit must be in the form of direct deposit, after acknowledgement and acceptance of this agreement. Following payment(s) may be by direct deposit.  Details for payment available on business website.


DELIVERY FEES
Slumber Nights will personally deliver the goods to an address nominated by the renter.  No mileage fee will apply to locations within 35km, encompassing locations within 35km from our home base in Knoxfield.  Outside of the 45km, a delivery fee of $20 will be charged. Distances are calculated according to GoogleMaps' fastest route.


DELIVERY OF GOODS
Slumber Nights will only deliver goods personally to the hirer.  The renter must therefore be present at the nominated address to accept the goods at an agreed upon time.  Failure of the renter to be present for collection will result in cancellation of event.  Cancellation policy will then apply.  Obligation is on the renter to inspect goods upon receipt and report (to the business) any damage to goods or discrepancies to the hire agreement, whilst the business is present.  


The business may, through negotiation with the renter, attempt to resolve any such faults or discrepancies prior to the event where practicable.  Slumber Nights is not obliged to compensate the renter for any such faults or discrepancies reported after the event.


SETUP OF GOODS
The renter is responsible for ensuring sufficient space is available and made clear for the equipment hired.  The website of the business provides necessary details of space required.  Slumber Nights will set up and disassemble equipment in accordance with description of product and services outlined on the website.


COLLECTION OF EQUIPMENT
The Slumber Nights will only collect goods personally from the renter.  The renter must therefore be present at the nominated address to return the goods at an agreed upon time.  Failure of the renter to be present for collection will result in additional hire charges.  The Slumber Nights will dismantle and pack equipment for collection.


DAMAGE TO EQUIPMENT
Damage to, or breakage of equipment during the hire period is the responsibility of the renter. Repair or replacement charges for damaged equipment will be executed after the hire date.


LIABILITY TO THIRD PARTIES
The Slumber Nights will not be liable for any personal injury, death or damage to property.
